- What will be visa status for wife/husband whose main applicant has HSMP ( Tier 1 ) visa ?
In HSMP ( Tier 1 ) visa scheme all dependants gets the same visa ,so they will be also be allowed to work legally fulltime for any employer.
Previous Earning
================
- For calculating previous earning , one should count CTC ( Cost to Company ) or net take home salary ?
Its CTC.it includes bonus or any income which is reflected in your payslip.
- How many months earning one need to show to become eligible for Tier 1 visa ?
Earnings must be made up of 12 consecutive months and must fall within the 15 months before your application.
You can claim points for a 12-month period outside of the 15-month period only in very limited circumstances. These are if you have been away from the workplace for a time during the last 12 months because of:
* full-time study; or
* a period of maternity or adoption-related absence.
You do not have to be in continuous employment during the 12-month period being assessed, so:
* you can claim for a period of earnings less than 12 months; and
* earnings do not have to be from a single employer and can be from full-time, part-time, temporary or short-term work.
If you claim for a period that is more than the 12 months, UK Home office will assess the most recent period of 12 months for which you have sent evidence.
Maintainence Fund

- What is maintenance fund requirement for HSMP ( Tier 1 ) Visa ?
To qualify for Tier 1 (General) of the Points Based System you must be able to demonstrate that you have funds to support yourself and any dependants. For the main applicant this is £2,800 with a further £1,600 needed for each dependant accompanying you or planning to join you within 12 months of your arrival in the UK.A These amounts must be held in your personal bank account for a minimum period of 3 months for which you must show bank statements/other evidence immediately preceding and dated no more than 7 days prior to the date you submit your application. The balance should not fall below the required minimum at any time during the 3 month period.
- Can i withdraw the fund once visa has been issued ?
Yes.You can.
- Does UK BA consider the FD ( Fixed Deposit ) for Maintenence fund ?
Fixed Deposite are valid for Maintenance fund as long as they can be liquidated when required.
Joint Account will be fine for maintainence fund or not ?
cash savings in a joint account that have been in your joint account for at least three months before your application is valid.
- International Account is valid for Maintenance Fund or not ?
cash savings in a account overseas (They convert the amount to pounds sterling using the rate which appears on the OANDA website, and the date on your bank statement), that have been in your account for at least three months before your application is valid.
I have submitted bank balance from aug4/09 to nov1/09(90 days)
they received my application on 12 nov
90 days enough?

For converting the salary in to GBP do we have to apply every month rate from the site or the rate applicable at the end of the period. ex if i am taking 12 months from Jan – dec 2009 do i have to apply exchange rate applicable every month and then calculate the earning in GBP or i total my earning and apply the rate applicable in Dec to convert the earnings

well i use to work in africa and i am MBA professional. i use to get salary slip and i receive salary in cash i can not produce document about salary credited in any bank account. so only salary slip will do for HSMP ?
and how much should be your past 12 month earning in indian rupees ?

I am planning to apply for Tier 1 after 06th March 2010 from India. I have a bank account in HSBC UK and got bank account statement on 30th March before leaving uk. I have a query, since my salary was credited in my bank account i used to transfer the amount to online bonus savers account which provide more interest rates. I have few concerns.
1. Now my query is will this amount can be treated as maintence funds. or the money should be in my bank account (main current account). I have bank account statement of the savers account with me. Can you please help here.
2. I was in uk for last 6 months on tier 2 visa. I have getting paid in uk allowance salary model and basic salary in india. Can you please let me know if i can show both these amounts (UK alloawance salary + India basic salary) along with my applications. Or should i use my last 15 months statement of india account and salary alone.

Hi i am from India and MBA professional. I want to apply for HSMP but was not working for 2 months in between if I consider applying today. It was because of change of location because of my wedding. How should I go about it? should I postpone the application?

I am in the UK since 4 years and want to apply for Tier 1 (General).
Can I claim for Previous Earnings with a single employer for 36 months i.e. 12 months consecutive 3 times ?
can my source of income be the same employer or not? I have checked this in home office website and it is allowing to add another source of earning with same employer. Please guide me on this.

I am going to apply for HSMP Tier 1 visa this month, i have few docubts listed below:
1. If my dependent is not applying for visa right now with me, 2800 pounds is sufficient as maintenance funds in my account?
2. My dependent will apply for visa in month of July 10 , till that time we will be able to maintain funds for him as well. Will there be any possibility of rejection for him or should we wait till we have funds for both and then apply.
3. i have filled the form but want somebody to check it once so that visa processing goes smooth, how can i do that?
4. Is there any time(specific months) when we should apply for IT jobs in UK . If we apply for Visa in May , what will be the frequency of job openings?

I’m going to apply for HSMP within UK, but I had few doubts which is really making me confused, can any of you please help me:
1- As a part of maintenance fund, do they consider Fixed deposit (FD) as well, as I have that in sweep in form in my india account.
2- For the maintenance fund, I need to show 4000£ as maintenance fund i.e. 800 for me & 1600 + 1600 for my wife n child. Now is it possible that I show this amount in different account i.e. 1500 in my account and 2500 in my wife account, but I’m not a joint account holder in my wife’s account.
Please reply asap, its really urgent.

Hi,
I wanted to enquire about definition of maintenance fund for Tier 1 General Category (Entry Level).
I have a Joint Fixed Deposit of 2 Laces with my elder brother (real brother), he is primary account holder and I am secondary account holder, will this kind of Fixed Deposit work fulfilling maintenance fund requirement.
I have read this instruction in UK VFS site http://www.ukvisas.gov.uk/en/howtoapply/infs/inf21pbsgeneralmigrant
“Documentary evidence for Maintenance (Funds)
Evidence must be in the form of cash funds. Other accounts or financial instruments such as shares, bonds, pension funds, etc., regardless of notice period are not acceptable. If you wish to rely on a joint account as evidence of available funds, you must be named on the account along with one or more other named individual.”
But I am not sure about the exact definition of maintenance funds in this case.

I want to apply for Tier-1 Visa. I am having query regarding previous earning. My accomodation allowance is shown in my salary slip but the allowance amount is not credited to my salary account. As per my contract the accomodation cost will be beared by the employer.
So can I include the accomodation allowance in my previous earning.

I was in UK from 2006 Feb to 2010 Jan. The last two years on psw. Right now I am in US , but I would like to come to UK on HSW visa..(Actually my husband would be applying for it and I would be going for dependnt). I would like to know will my experience in UK will help in any way? Also will it be better if we apply thru an agency or lawyer?.
